1.0 Acceptance
Acceptance of any order by Dangerous Substance Control Ltd (DSC-Ltd) for the supply of goods or services will be subject to the following conditions of sale and at the discretion of DSC-Ltd. No other conditions shall apply unless agreed in writing by DSC-Ltd with the buyer.

2.0 Prices

Whilst we shall endeavour to maintain the prices shown, this we cannot guarantee & we reserve the right to charge the price ruling at date of despatch. In the event of a price alteration after an order has been placed & prior to despatch notification of such alteration will be made before despatch of goods. Accessories and decoration in the photographs are excluded from the price of the products.

DSC-Ltd does however reserve the right to review any quoted prices 3 month after the respective quotation date.

3.0 Cancellations
A cancellation fee will be applicable for all goods manufactured to order, The charge will be determined at an appropriate rate to recover costs incurred by DSC-Ltd appropriate supplier. For items not manufactured to order, a 25% Restocking charge will be applicable at the discresion of the seller.

4.0 Specification
Due to continual improvements in the design and manufacturing process strict accuracy of specifications and illustrations cannot be always be guaranteed. So that any product improvements can reach the purchaser as soon as possible DSC-Ltd retains and reserves the right to make changes to design and specification without formal notice.

Stated load capacities are for Uniformly distributed loads (UDL)only and must not be exceeded at any time. Failure to ignore and conform to UDL data will invalidate the warranty.

5.0 Installation
Should installation be required, then this will be charged at an hourly rate and will include travel, vehicle, accommodation and subsistence costs.

6.0 Guarantee

DSC-Ltd ensures that the products are free from production as well as material defects. If operating or service instructions of DSC-Ltd or its third party suppliers are not obeyed, or if changes are made to the product, parts are replaced or expendable material are used, which do not correspond to the original specifications, then each guarantee is void. Warranty claims against DSC-Ltd are entitled only to the direct client. These requirements are not transferable. Guarantee starts from the date of delivery. Where the goods have been supplied by DSC-Ltd and are found to be defective, then DSC-Ltd shall arrange repair by a competent person, or at their discretion, replace defective goods free of charge within one year (unless otherwise stated) from the date of delivery, subject to the following conditions:

6.1 The buyer notifying DSC-Ltd in writing immediately upon the defect becoming apparent. 6.2 The defect being due to faulty design, materials or workmanship of the designated DSC-Ltd supplier. 6.3 Any goods to be repaired or replaced shall be returned to DSC-Ltd's designated supplier at the buyer’s expense, if so requested by DSC-Ltd and only once the buyer is in receipt of a goods return consignment number. NOTE: Goods will be rejected without the appropriate returns documentation. 6.4 Where the goods have been manufactured and supplied to DSC-Ltd by a third-party, any guarantee granted to DSC-Ltd in respect of the goods shall be passed on to the buyer. 6.5 DSC-Ltd shall be entitled at their absolute discretion to refund the price of the defective goods in the event that such price has already been paid. 6.6 Guarantee excludes product finish, locks, wheels & castors. 6.7 The remedies contained in this clause are without prejudice to the other terms & conditions herein.

7.0 Delivery
Delivery dates are estimates only and the company shall not be liable for any loss or damage resulting from any delay in delivery. Additionally, we reserve the right to make part deliveries.

In particular we shall not be liable for any matter which results from any act of God, war or riot, extreme weather, strikes or any other events which are beyond our control. The company reserves the right to deliver Goods by installments, each installment being treated as a separate contract. Goods will be delivered at the point most convenient to our carrier, usually the goods inwards dept or reception on the ground floor. Further transfer or installation within the purchasers premises, particularly for large or heavy items, must be arranged prior to delivery and will be charged extra. All goods must be examined and signed for on receipt.

8.0 Claims
All goods must be examined upon receipt & any damage or discrepancy noted on the carriers sheet. The company must be notified in writing of any damage or incomplete delivery within 3 working days of delivery.(excluding weekends).

No claims for shortage or damage will be entertained after a clear receipt has been given to the carriers. Should the buyer not receive the correct quantity, or if goods are received in a damaged condition, then the buyer MUST mark the delivery document as appropriate. The seller should then be notified immediately in writing, as claims will not be accepted beyond the three days from receipt of goods. The company will not be liable if this procedure is not followed. Total non delivery due to loss in transit must be notified within 7 days of invoice. Goods are not sold for any particular purpose, the end user should be responsible for the suitability of the product for use.

The company shall not be liable for any indirect or consequential loss arising out of or in connection with the sale of Goods.

9.0 Return of Goods

The return of goods will not be accepted in any circumstances without written prior agreement by DSC-Ltd and issue of an appropriate goods return consignment number and document. NOTE: Goods will be rejected without the appropriate returns documentation. Additionally, Standard goods will only be accepted for return after prior agreement with us and within 14 days of receipt. A handling charge will be imposed which will vary dependent on the condition of the goods when returned. Carriage charges for the outward journey plus the return of standard goods are payable by the purchaser.

Bespoke goods manufactured specially for a customer will not be eligible for return.

10.0 Reservation of Title

Goods supplied will remain the property of DSC-Ltd until full payment is received. In the event of sale of these goods to a third party DSC-Ltd reserves title to the proceeds of sale. Responsibility for maintenance and insurance passes to the purchaser on delivery.

11.0 Terms of Payment

Payment terms unless otherwise stated by DSC-Ltd shall be by on-line paypal. Where requested by the purchaser credit terms may be issued payable to DSC-Ltd in 30 days from the date of invoice. Longer payment terms must be agreed in writing.

None payment of monthly invoiced accounts will be subject to a service charge 1% above bank base rate per month.

12.0 Proper Law of Contract

This contract is subject to the law of England and Wales.
